Legitimate Self-Defence and Justification

Abstract

This paper analyses Carlos Nino’s general theory of legitimate defense and its relation with his conception about liberalism in criminal law. There are at least two problematic cases for his theory of legitimate defense. It is proposed an alternative availabe to avoid those problems which implies to advocate to the notion of non domination.
